Terms and Conditions

  1. Quotation and Acceptance

All projects begin with a formal written quotation valid for 30 days. Acceptance of the quote and these Terms and Conditions is confirmed by written approval or deposit payment.

  1. Scope of Works: New Build or Combination New Build

2.1 Our responsibility is limited to the design (if included), manufacture, and installation of the kitchen cabinetry as outlined in the accepted quotation.

We do not manage or coordinate full kitchen renovations, including but not limited to plumbing, electrical work, flooring, tiling, or appliance installations unless explicitly stated in writing.

2.2 Design and Specifications

Final kitchen design, materials, finishes, and hardware selections must be signed off in writing before production commences. Any requested changes after approval may result in additional charges and extended lead times.

2.3 Client-Supplied Appliances or Fixtures

Colourwheel Spray Works is not liable for incorrect measurements or compatibility of client-supplied items.

All specifications must be supplied before final design approval.

2.4 Variations

Any variations to scope must be agreed upon in writing and may affect price and timelines.

2.5 Ownership and Risk

Colourwheel retains ownership of all materials and components until full payment is received. Risk transfers to the client upon delivery or installation.

2.6 Cancellation

Cancellations after design approval may incur charges to cover design, materials, and labour committed to date.

2.7 Limitation of Liability

While we take the utmost care in our craftsmanship and installation, Colourwheel is not liable for indirect or consequential losses.

2.8 Site Conditions and Variations

The client is responsible for ensuring the site is accessible, level, and prepared as agreed before the scheduled work begins.

Any variations may result in additional requirements and charges.

Any changes to the site or unforeseen site conditions (e.g., uneven walls or floors, hidden plumbing or electrical issues, or structural obstructions) may require adjustments to the original scope of work.

In such cases, Colourwheel will issue a revised quote for approval before proceeding. These additional costs must be accepted in writing and may affect the timeline.

If the site is inaccessible, closed, or delayed for a period exceeding six (6) months, Colourwheel reserves the right to review and adjust the original pricing to reflect changes in material costs, labour rates, or availability.

2.8 Third-Party Contractors

While we may, at the client’s request, introduce or recommend third-party contractors (e.g. builders, electricians, plumbers, tilers), these parties operate independently of Colourwheel Spray Works and Cabinetry.

We are not liable for their workmanship, timelines, or outcomes, even if introduced or referred by us. Any coordination between trades must be clearly discussed in advance and confirmed in writing.

  1. Scope of works : In House Spray Painting

3.1 Colourwheel Spray Works and Cabinetry (‘Colourwheel’) offers professional in-house spray painting for new and existing cabinetry, furniture, panels, doors, and other components.

3.2 Services include preparation, priming, finishing, and topcoat spraying as per the agreed quotation.

3.3 Any additional work, such as repairs, sanding, filling, or colour matching beyond what is stated in the quote, will be charged separately.

3.4 Item Drop-Off and Collection

3.4.1 Items must be clearly labelled with client name and project details. X to mark for no spray work

3.4.2  Clients are responsible for safe delivery and collection of their items to and from our premises.

3.4.3 Colourwheel is not responsible for damage during transport unless we arrange and carry out the transport.

3.5 Surface Condition and Responsibility

3.5.1  All items must be clean, dry, and free from oil, silicone, or contamination before delivery.

3.5.2 If surfaces require additional preparation due to poor condition or previous coatings, this will be assessed and quoted separately.

3.6  Spraying over laminate or veneer may lead to delamination. Colourwheel is not liable for failure due to material separation.

3.7 Natural wood may expand and contract over time, affecting the sprayed finish. This is not covered under warranty.

3.8 Colour Matching and Finish

3.8.1 Colourwheel will provide samples for approval where requested. Charges will apply for sprayed custom  samples

3.8.2 Colour matches are offered at an accuracy of approximately 90%.

Exact matches to existing surfaces may not be possible.

3.8.3 Final finish quality depends on the material and original surface condition. Client-supplied samples or swatches must be reviewed and approved before spraying.

3.8.4 Colourwheels paint supplier can only match to a Dulux/ Plascon code, Some RAL codes  or a swatch

4.Scope of Works : Onsite Spray Painting

4.1 Colourwheel Spray Works and Cabinetry (“Colourwheel”) agrees to provide professional onsite spray painting services as detailed in the approved quote or project agreement.

4.2 The scope includes surface preparation, masking, priming (if specified), spray painting, and finishing of the agreed areas or items.

4.3 Any additional services requested will be quoted separately and must be agreed upon in writing.

4.4. Client Responsibilities

4.4.1 The client must ensure clear and safe access to the site during agreed working hours.

4.4.2 All furniture, fixtures, or fittings not being painted must be removed or adequately protected by the client unless otherwise agreed.

4.4.3 Colourwheel can assist with moving furniture where necessary; however, we cannot be held responsible for any damage caused during the process.

4.4.4  Water, electricity, and access to toilet facilities must be made available on-site at no cost to Colourwheel.

4..5. Site Conditions

4.5.1 All areas must be dry, dust-free, and adequately ventilated for optimal results.

4.5.2 Colourwheel reserves the right to delay work if site conditions are not conducive to professional spray application.

4.5.3 Colourwheel is not responsible for delays or additional costs caused by unforeseen conditions, including structural issues, excessive dust, or moisture.

4.5.4  While every effort is made to mask and contain the spray area, fine dust particles from the spraying process may settle in adjoining spaces. Clients should anticipate a level of post-job cleaning, which is the client’s responsibility unless otherwise agreed.

4.6  Health & Safety

4.6.1 Colourwheel adheres to all applicable safety and environmental regulations.

4.2 Spray technicians will wear appropriate PPE and use suitable extraction or ventilation systems where required.

4.3 Clients and third parties must avoid entry into the spray area during work and drying periods for health and safety reasons.

 4.7  Finishes and Colour Matching

4.7.1  Colour and sheen level must be approved prior to commencement.

4.7.2 While every effort will be made to match existing finishes, perfect matching cannot be guaranteed. Sprayed colour matches are offered to an accuracy of approximately 90%.

4.7.3 Final finish quality is dependent on the condition of the original surface. Repairs or surface preparation beyond basic sanding or cleaning will be quoted separately.

4.7.4 Natural wood is a living material and may expand or contract over time, which can affect the sprayed finish.

4.7.5 Spraying on laminate or veneer carries a risk of accelerating delamination. Colourwheel cannot be held responsible for delamination resulting from this process.

4.7.6  Spraying onto a vertical will result in different finish to spraying onto horizontal panel sprayed in an controlled environment like a spray booth

4.7.7 While every effort is made to achieve a high-quality finish, clients acknowledge that onsite spraying does not take place in a controlled environment like a spray booth. As such, factors such as dust, temperature, ventilation, and surrounding activity may lead to minor imperfections in the finish. By agreeing to onsite spraying, the client accepts that a factory-level finish cannot be guaranteed in these conditions.

4.8 . Damage and Liability

4.8.1  Colourwheel carries public liability insurance and takes reasonable care to protect surrounding areas.

4.8.2 Colourwheel is not liable for incidental damage caused by pre-existing defects, improperly secured fittings, contaminated substrates or natural material behaviour (such as wood movement or veneer separation).

  1. General

5.1. Deposits and Payment Terms

A 60% deposit is required to secure materials and begin production.

A further 30% is payable prior to delivery or installation commencement.

The remaining 10% is due upon completion.

Payments are due within 7 days of invoice unless otherwise agreed in writing.

 5.2. Lead Times

Estimated lead times will be provided at the time of order and commence from receipt of deposit and signed-off specifications.

Lead times are estimates and may vary due to material availability or unforeseen circumstances. And is quoted based on volume, complexity, and our existing production schedule.

Delays due to unforeseen preparation requirements, client changes, or supplier issues will be communicated promptly.

5.3 Installation

If installation is included, the client must ensure the site is ready, clean, and accessible on the agreed date.

Delays caused by site readiness or third-party contractors may incur extra costs.

5.4  Warranty

Our cabinetry and spray finishes are covered by a 2-year workmanship warranty under normal domestic use.

The warranty does not cover damage caused by water, misuse, wear and tear, or third-party work, unknown substrates on preexisting items. Note the cleaning instructions provided separately.

5.5 Acceptance of Terms

By paying the required deposit, the client acknowledges and agrees to these Terms and Conditions in full. A signed copy of this document is preferred, but not required, for the terms to take legal effect.

5.8 Snagging

A 28-day snagging period applies from the date of practical completion or handover of the sprayed area. Any concerns or issues must be reported in writing within this timeframe. After this period, any further remedial work may be subject to additional charges.

5.9 Protection of Sprayed Finishes

Once the project  is complete, it is the responsibility of the client, site manager, or principal contractor to ensure that all sprayed surfaces are adequately protected from damage. This includes protection from dust, debris, tools, equipment, and any activity by other trades. Colourwheel Spray Works and Cabinetry cannot be held liable for any damage, scratches, marks, or deterioration to the finish that occurs after completion due to inadequate protection or continued site work.

5.7  Governing Law and Jurisdiction

This agreement shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Magistrate’s Court of Cape Town, even if the amount in dispute exceeds the court’s monetary jurisdiction, unless Colourwheel Spray Works and Cabinetry chooses to proceed in a higher court.
